The Potential Consequences For An Identity Theft Conviction
Identity theft is one of the fastest growing crimes in America. It is a serious criminal offense that entails high fines and the possibility of jail time. Identity theft in Illinois is a felony, and the terms of your conviction will be determined by the degree.
Each conviction entails the consequences as determined by the price of the service or good, if it is:
- Between $300 and $2,000, it is a Class 3 felony and can result in two to five years imprisonment with the possibility of probation.
- Between $2,000 and $10,000, is it is a Class 2 felony and can result in three to seven years imprisonment with the possibility of probation.
- Between $10,000 and $100,000, it is a Class 1 felony and can result in four to 15 years imprisonment with the possibility of probation.
- More than $100,000, it is a Class X felony and can result in a minimum of six years imprisonment to a maximum of 30 years imprisonment. Probation is not possible for a Class X felony.
If the victim is 60 years of age or older or has a disability, your charge can escalate to aggravated identity theft. In addition, any subsequent aggravated identity theft charge will be a Class X charge regardless of the price of the service of good.
